Age discrimination victory
Friday 15 January 2010In Beck v Canadian Imperial Bank of Commerce an employment tribunal decided that a 42-year-old Head of Marketing who was dismissed on grounds of purported redundancy had been unfairly dismissed as the bank was actually actively seeking to recruit a replacement with a "younger, entrepreneurial profile". The tribunal determined that the bank's action amounted to age discrimination.
The burden was on the bank to explain the use of the word "younger" in the recruitment documents. The tribunal rejected the bank's assertion that the word "younger" simply meant less experienced.
