Deputyship

What is Deputyship?
Where a person is incapable of handling their own affairs and has not prepared for this event by making an Enduring or Lasting Power of Attorney, a Deputyship Application is all that is left available.
Anyone with an interest in the person’s situation can apply to the Office of the Public Guardian (OPG) to be appointed as a Deputy. The applicant does not have to be related to the individual who has lost capacity.
The application for Deputyship involves a certificate by a medical practitioner reporting on that person’s current and future physical and mental health. The applicant also has to make various promises that they will look after the individual’s affairs and must complete detailed forms concerning the individual’s financial assets and liabilities.
Once a Deputy is in place, they are under a duty to act in the best interests of the incapable individual at all times, and must report to the OPG each year.
